Resolução 01/2022

• Ratifica o texto do Acordo sobre o Estatuto Jurídico das Condições de Proteção e Colaboração entre o Governo de Sua Alteza Sereníssima e o Governo Provisório do Estado de Montenegro, concluído em Charlotte, em 6 de novembro de 2022.

O GOVERNO PROVISÓRIO no exercício de sua atribuição disposta no inciso VII do artigo 4º de sua Carta, e;

CONSIDERANDO que o Governo Provisório depositou o instrumento de assinatura do ato junto ao Ministério da Justiça, Cidadania e Direitos Humanos, em 6 de novembro de 2022;

CONSIDERANDO que o ato em apreço terá sua vigência iniciada, no plano jurídico interno, quando do recebimento do segundo instrumento de ratificação;

Resolve:

Art. 1º Fica aprovado, na forma em anexo, o texto do Acordo sobre o Estatuto Jurídico das Condições de Proteção e Colaboração entre o Governo de Sua Alteza Sereníssima e o Governo Provisório do Estado de Montenegro, concluído em Charlotte, em 6 de novembro de 2022.
Art. 2º A presente resolução terá sua vigência iniciada na data de sua publicação.

O Governo de Sua Alteza Sereníssima, de um lado, e o Governo Provisório do Estado de Montenegro, de outro, doravante denominados as Partes Contratantes,

ACREDITANDO que a pluralidade de ideias permite a um povo formar uma sociedade livre, justa e sem preconceitos;

CONSIDERANDO que a responsabilidade e a competência do Governo de Sua Alteza Sereníssima sobre os assuntos de soberania do Estado de Montenegro serão encerradas ao oitavo dia do mês de janeiro de dois mil e vinte e três (2023);

RELEMBRANDO o espírito de amizade e cooperação bilateral estabelecidos entre as Partes Contratantes pela Declaração Conjunta do Estabelecimento de Relações Diplomáticas e Cooperação entre o Principado de Belo Horizonte e o Reino de Montenegro, concluída em Venda Nova, em 10 de fevereiro de 2020;

que, havendo designado suas representantes em boa e devida forma, acordaram com o seguinte:


A responsabilidade e a competência do Governo de Sua Alteza Sereníssima sobre os assuntos de soberania do Estado de Montenegro, na forma do Tratado de Amizade, Colaboração e Proteção entre o Principado de Belo Horizonte e o Reino de Montenegro, concluído em Frankfurt, em 12 de julho de 2020, serão transmitidas ao Governo Provisório do Estado de Montenegro a partir do oitavo dia do mês de janeiro de dois mil e vinte e três (2023).


1. O Governo de Sua Alteza Sereníssima compromete-se a gradualmente reduzir e a retirar, até o oitavo dia do mês de janeiro de dois mil e vinte e três (2023), a presença de quaisquer oficial ou entidade atuando sob sua autoridade no território montenegrino.
1.1. o Comando-Geral da Guarda Nacional emitirá ordens dispondo sobre a ampla desmobilização de suas unidades de defesa estacionadas no território montenegrino;
1.2. o Ministério dos Assuntos Externos deverá comunicar aos Microestados estrangeiros sobre o fim de sua presença no território montenegrino, de forma a garantir ao Estado de Montenegro as condições ideais ao reconhecimento intermicronacional.
2. O Governo de Sua Alteza Sereníssima manterá, sob convite do Governo Provisório do Estado de Montenegro, a presença de servidoras públicas encarregadas de funções essenciais à administração pública no território montenegrino.


1. Sua Alteza Sereníssima, o Príncipe Soberano Dom Hiran abdica para si, seus herdeiros e sucessores, da Chefia de Estado do Estado de Montenegro, do título de Rei de Montenegro e do tratamento de Majestade.
1.1. a Coroa de Montenegro será incumbida a quem o Governo Provisório do Estado de Montenegro assim designar;
1.2. não serão mantidos ou estabelecidos novos títulos no sistema nobiliárquico belo-horizontino que falam referência direta ou indireta a Montenegro.
2. O Governo Provisório do Estado de Montenegro manterá o título de Príncipe da Carolina do Sul com o tratamento de Alteza Real ao Senhor Dom Hiran Miguel Domingues Bueno-Toniato.


1. O Governo Provisório, a partir do oitavo dia do mês de janeiro de dois mil e vinte e três (2023), assumirá autoridade total e completa sobre os assuntos de soberania do Estado de Montenegro, especialmente no que se refere a defesa, relações exteriores, organização do Estado e do Governo.
1.1. o Governo de Sua Alteza Sereníssima compromete-se a revogar ou suprimir as referências ao Estado de Montenegro e seu Governo Provisório de sua legislação, encerrando por completo quaisquer jurisdição do mesmo sobre o último;
1.2. a Governadora-Geral, a partir da data do início da vigência deste acordo, deverá ser uma cidadã montenegrina.
2. o Governo de Sua Alteza Sereníssima compromete-se a não alterar, revogar ou suprimir as referências ao Estado de Montenegro e seu Governo Provisório de sua legislação até o oitavo dia do mês de janeiro de dois mil e vinte e três (2023).


1. O Governo de Sua Alteza Sereníssima e o Governo Provisório do Estado de Montenegro comprometem-se a estabelecer, a partir do oitavo dia do mês de janeiro de dois mil e vinte e três (2023), mecanismos bilaterais de cooperação, da forma que observarem mais conveniente.
2. O cargo de Governadora-Geral do Estado de Montenegro deverá ser extinto ao oitavo dia do mês de janeiro de dois mil e vinte e três (2023), com o Governo Provisório assumindo suas funções.


O presente acordo tem força de lei e terá sua vigência iniciada após sua aprovação pelo Congresso Legislativo e pelo Governo Provisório do Estado de Montenegro.


EM FÉ DO QUE, as representantes designadas das Partes Contratantes fizeram e assinaram em boa fé em Charlotte, ao sexto dia do mês de novembro de dois mil e vinte e dois (2022), em dois originais em língua inglesa e em língua portuguesa, em caso de arbitragem, prevalecerá o original em língua portuguesa.

Pelo Governo de Sua Alteza Sereníssima:

Excelentíssima Senhora Presidenta do Conselho de Ministras Jade Tannure, Duquesa da Savassi;

Pelo Governo Provisório do Estado de Montenegro:

Sua Excelência, o Governador-Geral Rogério Nabosne.


The Government of His Most Serene Highness, on one side, and the Provisional Government of the State of Montenegro, on the other, hereinafter called the Contracting Parties,

BELIEVING that the plurality of ideas allows a people to built a free, fair and unprejudiced society;

CONSIDERING that the responsability and competence of the Government of His Most Serene Highness over the affairs of sovereignty of the State of Montenegro will be ended at the eight day of the month of january of two thousand and twenty three (2023);

REMEMBERING the spirit of friendship and bilateral cooperation established between the Contracting Parties by the Joint Declaration on the Establishment of Diplomatic Relations and Cooperation between the Principality of Belo Horizonte and the Kingdom of Montenegro, concluded in Venda Nova, at February 10, 2020;

that, having designated their representatives in good and due form, agreed with the following:


The responsability and competence of the Government of His Most Serene Highness over the affairs of sovereignty of the State of Montenegro, on the form of the Treaty of Friendship, Collaboration and Protection between the Principality of Belo Horizonte and the Kingdom of Montenegro, concluded in Frankfurt, at July 12, 2020, will be transmitted to the Provisional Government of the State of Montenegro from the eight day of the month of january of two thousand and twenty three (2023) beyond.


1. The Government of His Most Serene Highness compromises itself to gradually reduce and remove, until the eight day of the month of january of two thousand and twenty three (2023), the presence of any official or entity under its authority on montenegrinan territory.
1.1. the General Command of the National Guard shall issues orders on the wide demobilization of its defense units based in montenegrinan territory;
1.2. the Ministry of External Affairs shall comunicate the foreign Microstates of the end of its presence in montenegrinan territory, on way to guarantee to the State of Montenegro the ideal conditions to intermicronational recognition.
2. The Government of His Most Serene Highness shall mantain, under invitation of the Provisional Government of the State of Montenegro, the presence of public servants in charge of essential functions to public administration in montenegrinan territory.


1. His Most Serene Highness, Sovereign Prince Dom Hiran abdicates for him, his heirs and succesors, the Headship of State of the State of Montenegro, the title of King of Montenegro and the treatment of Majesty.
1.1. the Crown of Montenegro will be trusted to who the Provisional Government of the State of Montenegro so designates;
1.2. shall not be maintained nor established new titles on the belo-horizontinan nobiliary system that makes direct or indirect reference to Montenegro.
2. The Provisional Government of the State of Montenegro shall maintain the title of Prince of South Carolina with the treatment of Royal Highness to Mister Dom Hiran Miguel Domingues Bueno-Toniato.


1. The Provisional Government, from the eight day of the month of january of two thousand and twenty three (2023) beyond, shall assume total and complete authority of the affairs of sovereignty of the State of Montenegro, specially on what refers to defense, foreign affairs, State and Government organization.
1.1. the Government of His Most Serene Highness compromises itself to revoke or suppress the references to the State of Montenegro and its Provisional Government from its legislation, completely ending any jurisdiction of the same to the last;
1.2. the Governor General, from the date of the start of enforcement of this agreement, shall be a montenegrinan citizen.
2. The Government of His Most Serene Highness compromises itself not to alter, revoke or suppress the references to the State of Montenegro and its Provisional Government from its legislation until the eight day of the month of january of two thousand and twenty three (2023).


1. The Government of His Most Serene Highness and the Provisional Government of the State of Montenegro compromises themselves to establish, from the eight day of the month of january of two thousand and twenty three (2023), bilateral mechanisms of cooperation, in the from they see more convenient.
2. The office of Governor General of the State of Montenegro shall be extinguished at the eight day of the month of january of two thousand and twenty three (2023), with the Provisional Government assuming its functions.


The present agreement shall have force of law and be enforceable after its approval by the Legislative Congress and by the Provisional Government of the State of Montenegro.


IN WITNESS THEREOF, the designated representatives of the Contracting Parties have done and signed in good faith in Charlotte, at the sixth day of the month of november of two thousand and twenty two (2022), in two originals in english language and portuguese language, in case of arbitration, the original in portuguese language shall prevail.

For the Government of His Most Serene Highness:

The Most Excellent Madam Chairwoman of the Council of Ministers Jade Tannure, Duchess of Savassi;

For the Provisional Government of the State of Montenegro:

His Excellency, Governor General Rogério Nabosne.
